Are you an employer, a contractor or a recruitment agency that works for a business that has two or more of the following features.


A turnover of more than £10.2 Million.

A balance sheet of more than £5.1 million.

Has 50 or more employees.


From April 1 2021, under new IR35 Legistaliton, large and medium-sized organisations in the private sector who engage contractors through intermediary companies will be responsible for assessing the employment status of those contractors.


Currently, those working in the private sector are solely responsible for determining employment status. Under the new rules, where workers are engaged through their own companies, the responsibility to apply IR35, and to pay any associated tax and National Insurance contributions (NICs), will fall to the private company, agency or other third party paying the worker’s company.


HMRC have put together an employment Status test that they will stand by to determine where you stand with IR35 from April 2021.
